Divorce Litigation
It may not feel like it, but divorce litigation is treated as a dissolution of a contract. That is why it is referred to in Colorado courts as a "dissolution" rather than a "divorce."
The married couple's union is treated like two business partners who have decided to dissolve the company. There are typically two major issues: (1) how to define and equitably divide the marital assets, and (2) how to deal with any minor children. The State considers children as property of the State and therefore has jurisdiction to consider their best interests. The "rights" of parents is of less importance to the Courts than the rights of the State in ensuring the best interests of the child.
